CESAR E. CORTES V. UNIVERSITY & STATE EMPLOYEES CREDIT UNION (NKA BLUPEAK CREDIT UNION)

United States District Court Southern District of California
Case No. 22-cv-444-LAB-DEB

Welcome to the Settlement Website for the University & State Employees Credit Union Overdraft Settlement

If you have or had a checking account with University & State Employees Credit Union (now known as Blupeak Credit Union) (“Defendant”) and you were charged an overdraft fee on a one-time debit card or atm transaction between March 17, 2021, and August 18, 2023, then you may be entitled to a payment from a Class Action Settlement.

If you are a member of the Settlement Class, you have the following options:

SUMMARY OF YOUR OPTIONS AND THE LEGAL EFFECT OF EACH OPTION

DO NOTHING

If you fall within the class definition (described below) and do nothing in response to the Notice, you will remain a member of the Class and are eligible to automatically receive a settlement check or account credit once the settlement is finally approved. However, you will also give up the right to file a separate lawsuit against Defendant regarding the issues covered and resolved by the settlement.

EXCLUDE YOURSELF FROM THE SETTLEMENT; RECEIVE NO PAYMENT BUT RELEASE NO CLAIMS

You can choose to exclude yourself from the settlement or “opt out.” This means you choose not to participate in the settlement. Excluding yourself is the only option that allows you to bring your own lawsuit against Defendant concerning the claims and legal issues covered and resolved by the settlement. All exclusion requests must be submitted by U.S. Mail to the address listed below under question 16 - postmarked no later than March 25, 2024.

OBJECT TO THE SETTLEMENT

If you do not like the settlement and you do not exclude yourself, you can file an objection with the Court explaining why you believe the Court should reject the settlement. All objections must be submitted by U.S. Mail to the addresses listed below under question 19, postmarked no later than May 24, 2024. If you submit a written objection, the Court will take it into account in considering whether to approve the settlement.

These rights and options – and the deadlines to exercise them – along with the material terms of the settlement are explained in the Notice.
